Permanent Residence South Africa

Permanent residence applications, with eligibility checks and guidance on permanent residence conditions.

What

Permanent Residence Means

Permanent residence allows qualifying foreign nationals to live and work in South Africa without having to renew temporary visas.
Applications are technical and evidence-driven. Status history, supporting documents, and compliance remain critical.

Permanent Residence Categories

If you have held a continuous work visa for five years, you may qualify for permanent residence. You will need a permanent offer of employment from a South African entity in order to apply.

Holders of a critical skills visa may apply for permanent residence if they have more than five years of post-qualification experience. You will need to show that you are currently working in a field listed on the Critical Skills List and provide proof of registration with the relevant professional body.

If you have been married or in a permanent life partnership with a South African citizen or permanent resident for more than five years, you may apply for permanent residence. You will need to provide proof of a “good faith” relationship in the form of a marriage certificate or shared financial responsibility in the case of a life partnership.

If you are able to demonstrate a lifelong monthly income of at least ZAR 37,000 from a pension, annuity, or net worth, you may be eligible to apply for permanent residence.

If you have established or invested in a business in South Africa with an investment amount of ZAR 5 million or otherwise prescribed, you may apply for permanent residence. You will have to show that your business’ staff compliment is comprised of at least 60% South African citizens or permanent residents.

This is a direct route to permanent residence for high-net-worth individuals. You will need to show a net worth of ZAR 12 million and, upon approval, undertake to pay ZAR 120, 000 to the Department of Home Affairs. This route does not have a corresponding temporary residence visa. If you would like to take up residence pending the finalisation of this application, you may choose to apply for a temporary residence visa in the interim.

There are two main routes to permanent residence through family ties.
You may qualify for permanent residence if you are either:

a) The child of a citizen or permanent resident; or
b) the relative (within the first degree of kinship) of a citizen or permanent resident

Permanent Residence Conditions

Permanent residence holders have the same rights and responsibilities as a citizen, save for certain exceptions (for example, the right to vote).

Certain categories of permanent residence may contain specific compliance conditions. For example, permanent residence holders under the business investment category must be able to show that the financial contribution remains invested in the business for a number of years.

In certain circumstances, proof of your permanent residence may be required. In particular, if your permanent residence was granted under previous immigration legislation or if you intend to apply for citizenship.

Permanent residence may be withdrawn in certain circumstances, including prolonged absence from South Africa.
